Fun Facts #1

The implementation of something like abortion isn’t inherently in the power of the US President, and no it’s not only in the power of the states. Since Roe v. Wade in 1973, the supreme court made the ability to have an abortion up to 20 weeks a protected right. Prior to it being struck down, if Congress were to make a law about it- the Supreme Court would simply knock the law down unless a supermajority in congress passes the law as an amendment. The president can’t turn on/off abortion since he can’t make laws or determine if something is constitutional or not.

Since it was struck down in 2022, states have had differing legal opinions and implementations of abortion. This isn’t because states have the final say on abortion. but rather because there is no federal law on abortion. If the federal government were to make a law on abortion now- the supreme court can’t strike it down and the states would have to follow it.
